Terms of Service

PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT" OR "TERMS OF SERVICE") CAREFULLY BEFORE USING THE SERVICES OFFERED BY LANHIVE.COM. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE LANHIVE WEBSITE AND ALL RELATED SERVICES, INCLUDING, WITHOUT LIMITATION, ANY FEATURES, CONTENT, OR APPLICATIONS OFFERED FROM TIME TO TIME BY LANHIVE IN CONNECTION THEREWITH (COLLECTIVELY, "SERVICE(S)"). BY USING THE SERVICES IN ANY MANNER, YOU AGREE TO BE BOUND BY THIS AGREEMENT.

"The Site" refers to the website operated by LanHive, including but not limited to lanhive.com, as well as any associated applications, services, features, content, and functionalities offered by LanHive.

1. Acceptance of Terms of Service

The Service is offered subject to acceptance without modification of all of these Terms of Service and all other operating rules, policies, and procedures that may be published from time to time in connection with the Services by LanHive. Some services offered through the Service may be subject to additional terms and conditions promulgated by LanHive from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.

LanHive may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law, and the right to access the Service is revoked in such jurisdictions.

2. Platform Description

LanHive is a platform that enables users to generate images, videos, and audio content ("Assets") using a selection of leading AI models. Users may choose from the available AI models to generate Assets according to their needs. Access to Asset generation is granted upon the purchase of non-expiring credits; no subscription plan is required. Credits do not expire and remain valid on your account until used.

3. Eligibility and Age Requirements

By accessing the Services, you confirm that you are at least 18 years old and meet the minimum age of digital consent in your country. If you are under 18 or the legal age in your country (whichever is higher), you are prohibited from using this platform. It is your responsibility to ensure compliance with your local laws regarding age restrictions for digital services.

If you are a parent or legal guardian and allow your teenager to use the Services, these terms also apply to you, and you are responsible for your teenager's activity on the Services.

4. Rules and Conduct

As a condition of use, you agree not to use the Service for any purpose that is prohibited by these Terms of Service. You shall not (and shall not permit any third party to) use the Site, any Assets, or our AI models to:

  • Violate any applicable law, rule, or regulation.
  • Infringe upon any intellectual property or other right of any other person or entity.
  • Threaten, abuse, harass, defame, deceive, defraud, or invade another's privacy.
  • Create Assets that exploit or abuse children in any way.
  • Generate or disseminate verifiably false information with the purpose of harming others.
  • Impersonate or attempt to impersonate any person or entity.
  • Generate or disseminate personally identifying or identifiable information without consent.
  • Create Assets that imply or promote support of a terrorist organization.
  • Create Assets that condone or promote violence against people based on any protected legal category.
  • Generate nude, semi-nude, or sexually explicit content of any person.
  • Create non-consensual intimate imagery (NCII) of any kind.
  • Produce any sexual or explicit content involving minors.

LanHive is NOT a "nudifier" or "undressing" application and must not be used as one. In accordance with the EU AI Act and other applicable regulations, AI-generated intimate imagery created without consent is illegal. We actively detect and block NSFW content using automated systems. Accounts found violating this policy will be immediately suspended, their remaining credits forfeited, and the violation reported to relevant authorities where required by law.

5. Video and Audio Generation

LanHive's video and audio creation functionality is strictly for lawful and ethical purposes. By using the platform, you agree NOT to create or distribute content that:

  • Impersonates real individuals without their explicit consent.
  • Engages in or promotes scams, fraud, or other misleading activities.
  • Promotes or sells illegal products, services, or content.
  • Engages in political campaigning, advocacy, or misinformation.
  • Produces deepfake content with the intent to deceive, defraud, or mislead others.
  • Violates privacy or portrays individuals in a harmful or false light.
  • Distributes violent, hateful, or discriminatory content of any kind.

You agree to use video and audio generation only for positive and lawful purposes, including but not limited to: creating advertisements for legitimate products and services, educational or tutorial content, explainer videos, and other uses that comply with applicable law and these Terms.

6. Content Involving Minors

By using the Service, you expressly acknowledge and agree that you will not upload, post, generate, or share any photographs or content depicting minors (individuals under the age of 18). We reserve the right to monitor and review uploaded and generated content. If we identify any content featuring minors, we will immediately remove such content and report instances of potential child exploitation or abuse to appropriate law enforcement authorities in the relevant jurisdiction. By using our platform, you consent to such monitoring, review, and reporting.

7. Technical Restrictions

You shall not (directly or indirectly):

  • Take any action that imposes an unreasonable or disproportionately large load on LanHive's infrastructure or third-party providers.
  • Interfere with or attempt to interfere with the proper working of the Service.
  • Bypass any measures LanHive uses to prevent or restrict access to the Service.
  • Use any method to extract data from the Services, including web scraping, web harvesting, or data extraction tools, except as permitted through an authorized API.
  • Reverse assemble, decompile, translate, or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Services.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without express written permission from LanHive.

8. Credits, Fees, Payments and Refund Policy

LanHive operates on a non-expiring credit system. There is no subscription required. Credits are purchased in advance and may be used to generate Assets at any time; they do not expire.

You agree that LanHive provides immediate access to digital content generation upon credit purchase. Due to the high costs of GPU processing, we are not able to offer refunds on purchased credits, as server resources are reserved and costs are incurred immediately upon each generation request. By purchasing credits, you expressly acknowledge and accept this policy.

LanHive reserves the right to change its credit pricing and model offerings at any time. Changes to pricing will not affect credits already purchased. Unless otherwise stated, fees do not include federal, state, local, and foreign taxes, duties, and other similar assessments. You are responsible for all taxes associated with your purchases.

Each person must maintain a unique account. You are responsible for any activity conducted on your account. A breach or violation of any of these Terms of Service may result in the immediate suspension of your account and forfeiture of unused credits.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Licensing Terms

Subject to your compliance with this Agreement, LanHive grants you a non-exclusive, limited, non-transferable, freely revocable license to access and use the Service for personal or business use. You own all Assets you create with the Services, and LanHive hereby assigns to you all rights, title, and interest in and to such Assets for your personal or commercial use, subject to these Terms.

By using the Services, you grant to LanHive a perpetual, worldwide, non-exclusive, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, and distribute text prompts, input media, and Assets produced by the Service, solely as needed to provide, maintain, promote, and improve the Services and to comply with applicable law and enforce our policies. This license survives termination of this Agreement.

10. DMCA and Takedowns Policy

LanHive utilizes artificial intelligence systems to produce Assets. Such Assets may be unintentionally similar to copyright-protected material or trademarks held by others. We respect rights holders internationally and ask our users to do the same. If you believe copyrighted material on the Site is being used in a way that infringes a copyright over which you are authorized to act, you may submit a Notice of Infringing Material in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

We will terminate or disable access for users deemed to be repeat copyright infringers.

11. Modification of Terms

At its sole discretion, LanHive may modify or replace any of these Terms, or change, suspend, or discontinue the Service at any time by posting a notice on the LanHive website or by sending you an email. It is your responsibility to check these Terms periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

12. Termination

LanHive may terminate your access to all or any part of the Service at any time if you fail to comply with these Terms, which may result in the forfeiture and destruction of all information associated with your account, including any unused credits. Either party may terminate the relationship at any time upon written notice. Any credits purchased are non-refundable upon termination. Upon termination, all rights and licenses granted to you under this Agreement shall immediately terminate.

13. Indemnification

You shall defend, indemnify, and hold harmless LanHive, its affiliates, and each of their employees, contractors, directors, suppliers, and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to (i) your use or misuse of the Service, or (ii) your violation of these Terms or any applicable law, contract, policy, or regulation.

14. Limitation of Liability

IN NO EVENT SHALL LANHIVE OR ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICE FOR: (I) ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND; (II) YOUR RELIANCE ON THE SERVICE; OR (III) ANY DIRECT DAMAGES IN EXCESS (IN THE AGGREGATE) OF THE AMOUNTS PAID BY YOU FOR CREDITS IN THE SIX (6) MONTHS PRECEDING THE CLAIM OR, IF GREATER, $500.

YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE SERVICE OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR BE FOREVER BARRED.

15. Disclaimer

ALL USE OF THE SERVICE AND ANY CONTENT IS UNDERTAKEN ENTIRELY AT YOUR OWN RISK. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. LANHIVE MAKES NO WARRANTY THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS, (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (C) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

16. Trademarks

All LanHive logos, marks, and designations are trademarks or registered trademarks of LanHive. All other trademarks mentioned on this website are the property of their respective owners. The trademarks and logos displayed on this website may not be used without the prior written consent of LanHive or their respective owners.

17. Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR RIGHTS.

Agreement to Arbitrate

You and LanHive agree that any and all disputes, claims, or causes of action ("Claims") that have arisen or may arise between you and us — whether arising out of or relating to these Terms, the Site, or any aspect of the relationship or transactions between us — will be resolved exclusively through final and binding arbitration before a neutral arbitrator, rather than in a court by a judge or jury, except that either party may assert individual Claims in small claims court if such Claims are within that court's jurisdiction.

By entering into these Terms, you and LanHive each waive the right to a trial by jury or to participate in a class action. The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.

Prohibition of Class Actions

YOU AND LANHIVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

Arbitration Process

Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's ("AAA") Consumer Arbitration Rules in effect at the time of initiation. Any arbitration hearings will take place in Singapore or at another mutually agreeable location, or by telephone or video conference if both parties agree. The arbitrator will issue a reasoned written decision explaining the essential findings and conclusions on which any award is based.

Opt Out

You may reject this Arbitration Agreement by sending an opt-out notice to LanHive within thirty (30) days after you first access the Site. The opt-out notice must include your name, phone number, and the email address associated with your account.

18. Choice of Law

Any and all Claims shall be governed by the Federal Arbitration Act and the internal substantive laws of Singapore, without regard for the jurisdiction in which the user is domiciled, resides, or is located. Except as provided in the Arbitration Agreement, all Claims will be brought in the courts of Singapore, and you irrevocably consent to the exclusive personal jurisdiction and venue of those courts.

19. Miscellaneous

These Terms of Service constitute the entire agreement between you and LanHive with respect to the Service, and supersede all prior or contemporaneous communications and proposals between the parties. If any provision is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. You may not assign or transfer your rights or obligations under these Terms without LanHive's prior written consent. LanHive may assign, transfer, or delegate any of its rights and obligations without consent.
